Terms of Use

These Terms of Use (“Terms”) are a contract between you and Rdea Pty. Ltd. (ABN 20 617 307 794) (“Heero Kids”, “we”, “us”). By accessing or using our services, you agree to these Terms. If you are under 18, a parent or guardian must read and agree on your behalf.

Read these Terms with our Privacy Policy.

1. The service

Heero Kids is a real-world, map-based game. The live app includes teams, collectible heeroes, and capturing neighbourhood turf (including the flag hunt). The app may also include NFC scans of physical pod stickers, quests, and in-app purchases when we make those features available.

The service is provided “as is” and may change, pause, or end features with reasonable notice where practicable.

2. Eligibility and accounts

  • A parent or guardian should create or approve the account and device permissions (including location and NFC).
  • Keep recovery codes and the device secure. Do not share an account to cheat or harass others.
  • We may suspend or terminate accounts that breach these Terms or pose a safety risk.

Parents and guardians are responsible for a child’s use of the service.

3. Acceptable use

You agree not to:

  • Use the service to harm, groom, lure, stalk, or harass any person, especially children
  • Attempt to discover or share another player’s precise location, home, school, or routine
  • Cheat, exploit bugs, use unauthorised automation, or interfere with servers or other users
  • Impersonate others or misrepresent identity
  • Upload unlawful, offensive, or infringing content
  • Reverse engineer or scrape the service except where law permits
  • Place or promote pod stickers in a way that encourages unsafe play

We design turf and map features so other players do not see a live pin of where a named child is. You must not use workarounds (third-party tools, doxing, and the like) to undermine that.

4. Real-world play and safety

  • Play safely. Follow road rules, respect private property, and obey school and venue rules. Do not play while driving or in dangerous places.
  • Supervision. Younger children should play with a trusted adult nearby.
  • Emergencies. The service is not an emergency or monitoring service. Call 000 in an emergency.

We are not responsible for injuries, property damage, or disputes arising from how or where you choose to play, except where the Australian Consumer Law does not allow that exclusion.

5. Physical pod stickers

Some play uses NFC stickers (pods) placed in the real world. Official stickers and unofficial or player-placed stickers may both appear in public.

  • We do not authorise anyone to trespass, climb, attach stickers to property without permission, or place stickers where scanning them would be unsafe (for example at height, in traffic, on private property, or anywhere a child could be hurt).
  • We are not liable for stickers that other people place, or for damage to property or injury that comes from placing, looking for, or scanning a sticker.
  • Finding a sticker in the app or on a map is not permission to go there or to touch someone else’s property.

Reporting a sticker

If a sticker is missing, vandalised, or in a place that could endanger someone who tries to scan it, email support@heero.kids with the location and what you saw.

When we reasonably can, we will turn off the virtual pod in the app so players are no longer encouraged to scan that sticker. Reporting is by email today.

6. Location

Map features need device location permission. Our Privacy Policy explains that we use location for game zones and validation, not to show other players a live pin of a named child.

You can revoke location in device settings. Some features will not work without it.

7. Virtual items and purchases

  • In-game currency, heeroes, turf outcomes, and similar items are licensed, not sold as physical goods, unless we say otherwise.
  • When we offer in-app purchases, they are processed by Apple. Apple’s terms and refund rules also apply. We do not store your card number.
  • We may adjust game balance (rewards, capture rules, Energy, and the like) for fairness.

Refund rights under the Australian Consumer Law are not excluded. Statutory guarantees may apply to paid goods and services.

8. Intellectual property

We own (or license) the Heero Kids name, art, software, and content. You receive a limited, non-exclusive, revocable licence to use the app for personal, non-commercial play.

Anything you submit (for example a quest photo) must not infringe others’ rights. You grant us a licence to use it only as needed to operate the service.

9. Third-party services

The app uses third-party services (accounts and hosting, maps, and device platforms). Their terms and privacy policies apply to those services.

10. Disclaimer of warranties

To the maximum extent permitted by law, we disclaim warranties not required by the Australian Consumer Law. Nothing in these Terms limits guarantees that cannot be excluded (including for services not supplied with due care and skill).

11. Limitation of liability

To the extent permitted by law, our liability for breach of these Terms or negligence is limited to resupply of the services or refund of amounts paid for the relevant period, except where liability cannot be limited (including under the Australian Consumer Law).

We are not liable for indirect or consequential loss (for example lost profits or data) except where prohibited by law.

Without limiting the above, we are not liable for unofficial stickers, unsafe sticker placement, or property damage caused by people placing or seeking stickers, except where the Australian Consumer Law does not allow that exclusion.

12. Termination

You may stop using the service at any time. We may suspend or terminate access for breach, safety risk, or if we discontinue the service. Provisions that should survive (including these limits, privacy, and dispute terms) continue after termination.

13. Changes

We may update these Terms. We will change the “Last updated” date and, for material changes that affect children, give a clear notice where we reasonably can (for example in the app). Continued use after the effective date is acceptance where the law allows.

14. Disputes and governing law

These Terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria.
